Trump may delay January 6 Subpoenas until after GOP could win House

  • On Friday, Trump was officially subpoenaed by the January 6 Committee.
  • Trump who refuses compliance could be held in contempt by Congress and possibly prosecuted.
  • Trump could extend the process to the end, or even until the committee is over.

To avoid the January 6 subpoena, Donald Trump used a fairly straightforward legal tactic: delay.

After nearly a year-long investigation into the Capitol attack the House select Committee announced its decision on October 13. Unanimity of decision to subpoenaThe former president was available for testimony and documents. Trump was the only one who could provide crucial information about the 2020 election results, according to lawmakers.

The panel officially Trump was subpoenaedOn Friday, he received a request to turn over documents by November 4, and to testify on or about November 14. Trump was accused in the letter of having overseen efforts to overturn election results and being a promoter of fraud claims he knew to be false.

Trump dismissed the committee, and continued to make false claims about voter fraud. Trump has not yet indicated whether he will obey the subpoena. However, his lawyer stated that he would. The New York TimesFriday, they reviewed it and also criticised the committee’s decision to release it publicly.

Trump could be held in contempt for failing to cooperate with the subpoena and referred by the Justice Department for trial. However, if Republicans take back the House in November — as they appear likely to do — the committee itself could be over.

In the summer 2021, the January 6 committee was formed. Senate Republicans sank a bipartisan commission in the style of 9/11.. Kevin McCarthy, House Minority leader, appointed no one to the select committee after it was established. Nancy Pelosi, Speaker of the House, rejected two out of five picks by Mr. Pick.. The committee was made up of two Republicans, Reps. Liz Cheney, and Adam Kinzinger. Both are Trump critics, which have been widely rejected by the GOP.

The committee has already interviewed over 1,000 people during its investigation. With the 117th Congress, dissolveJanuary 3, Meanwhile, Republicans seem well-positionedTo Win the HouseIn midterm elections.

McCarthy would be the most likely candidate for House speaker, if Republicans win control of the House in January. However, Republicans seem certain to end the work of this committee. This could put an end to legal battles that sought to force Trump to comply with the subpoena.

Trump could make a variety of legal moves to extend the process, even though the deadline for subpoena is set for November. This was months ahead.

“If a witness refuses or is unable to appear, then it’s time for the House of Representatives to vote on the contempt citation,” a unnamed Democratic congressional staffer stated. The Washington Post. “If we hold the House it’s an actual civil case. However, that’s not always guaranteed.”

According to people familiar with the situation, Trump’s team might consider suing Congress to delay the proceedings. The committee claims it does not have the power to make him testify. It’s not yet clear whether the lawsuit would succeed but it could drag out the process until the end.
