NY Law allows survivors of adult sexual abuse to sue after the statute of limitations

  • New York’s new law allows survivors of sexual assault to file new lawsuits, regardless of the time period in which the abuse took place.

On Thursday, the Adult Survivors Act was implemented by Kathy Hochul, New York Governor. The law gives survivors one year to file civil lawsuits against anyone they accuse of sexual abuse. 

The law allows survivors to sue schools, businesses and religious institutions that are allegedly complicit in any wrongdoing.

For survivors to be eligible, they must have been at least 18 years old when the abuse took place. An earlier New York law, The Child Victims Act (NY), gave similar rights to minors. 

Hochul stated that while our work is far from done, the goal of ending sexual assault is to be able to bring those responsible to justice. Hochul made this statement at the signing of the law.
