Jury convicts FBI Agent of 2020 Metro Shooting in Maryland

A jury found Friday that an FBI agent was not guilty in the shooting of a Metro passenger in 2020. Near Bethesda (Md.

Eduardo Valdivia was on a Red Line train at the Medical Center station, Dec. 15, 2020 when a man approached him and asked for money.

Valdivia refused to answer the request and there was a confrontation. According to reports, the man said he muttered expletives while he turned his back on the agent.

Video of the incident was released Wednesday showing Valdivia shooting at the man from close quarters. While another passenger leaves, the man falls and then sits down across from Valdivia.

The man and Valdivia appeared to be having a conversation before Valdivia reached for his gun. Valdivia grabs his gun and shoots him as they continue to talk. 

The agentHe continued to point his gun at the man. The man stumbled, then hunched forward before taking a place. Valdivia is still seen speaking and gesturing at the man. The other passenger rises and appears to be making a call.

Valdivia appears to be speaking to the third person and signals for a telephone as he talks to him. 

As he continues to hold onto the gun, the agent appears to address both men. Valdivia eventually stops the train and motions for his shot man to follow him. He eventually follows Valdivia, walking slowly and hunched up.

According to a 2021 911 call, another passenger reported that Valdivia was approached and warned by the third man.

The caller stated that the agent had called the third man and asked him to come fight with him. According to the caller, the agent said to the man “Move away. I’m an FBI agent.” “Back away,” the agent said, and fired two to three rounds.

Valdivia wurde Accused of attempted murderHe was arrested in 2021. He was also charged with first-degree assault, firearm usage/felony/violent crime, and reckless endangerment.

Robert Bonsib (a lawyer for Valdivia) suggested that the agent be given the benefit-of-the doubt because of his experience and law enforcement training.

“I think it’s important to remember that this is an agent who is used to working in dangerous and undercover capacities. He can read body language and recognize changes. He can sense danger when it is near. Bonsib said that he could feel danger as it approaches” in a statement released in 2021.

The verdict on Friday found Valdivia not guilty of all charges.
