Axios: Former Trump lawyer warns about inaccurate voter fraud claims

A Trump White House ex-lawyer said that he was “concerned about Donald Trump signing an affidavit confirming false allegations against voter fraud in support for a complaint. Axios obtained an email that showed the following:.

The message was about a lawsuit Trump and his legal teams were set to file against Georgia Governor. Around December 2020, Brian Kemp and Brad Raffensperger, the secretary of state of Georgia, received this message. This was an attempt to decertify the presidential election results of the state.

Cleta Mitchell was an attorney and former Trump advisor. She sent Eric Herschmann a draft of the suit on December 30, 2020. The next day she would send another draft to Eric Herschmann, claiming that it was a “version of John Eastman”, the man who plotted to reverse the state’s results.

Herschmann replied on December 31, 2020, “I will review now.” John edited my letter, but I did not send John any edits. I expressed concern about the President signing a verification regarding facts that might not be sustainable after careful scrutiny.

Herschmann wrote, “I believe that we should limit specific factual ‘number’ allegations to those that need to be made. Those that prove that the decision is final.” Molly Michael, Trump’s assistant and former chief of staff Mark Meadows, was also included in the email.

Insider reached Herschmann for comment but he did not respond immediately. Axios received a statement from Herschmann stating, “I amn’t discussing my conversations or the surrounding circumstance.”

Herschmann had previously indicated that he doubted plans to subvert the 2020 election.

His Deposition before the January 6th committeeHerschmann also recalled dismissing Eastman’s plans to decertify this election.

Eastman said that he had told him “I said to you, ‘are ya out of your effing head,'” he later recalled saying. “I only want two words to come out of your mouth, orderly transition.

Two days ago, a federal judge ordered Eastman’s release of additional correspondence to the January 6 committee to be reviewed. It’s not known if Herschmann’s email was one of those messages.

Eastman is currently engaged in legal battles trying to defend against subpoenas of the committee for email and phone records.

Eastman did not respond immediately to a request for comment.

On Wednesday, David Carter, a US District Court Judge, ruledEastman should give a collection of emails dating between November 3, 2020 and February 20, 2021 to Carter. Carter claimed that some of the correspondence revealed that Trump knew specific numbers of voter corruption, and continued to promote them both in court as well as to the general public.

Carter wrote that “The Court finds these emails are sufficiently connected to and in support of a conspiracy defrauding the United States.”

Trump representatives didn’t immediately respond to a request of comment.

Trump replied to Carter by saying on Truth Social that he “shouldn’t be making statements regarding me until he understands all the facts.”
