Alabama execution postponed after death warrant expires

Hours after approval The United States Supreme Court is dividedAlabama halted execution of Alan Eugene Miller because of problems accessing his veins, and time restraints.

Alabama Department of Corrections Commissioner John Hamm stated that Miller’s veins were not accessible and the lethal injection protocol would not be complete before the death warrant expires at 11:59 on Thursday. Fox 6 Birmingham reported. 

Miller is reported to be alive and in his Holman Correctional Facility cell. Hamm also confirmed to media that an ambulance left the prison but was not connected with the execution, according to the outlet.

Gov. Kay Ivey issued a statement on Friday morning, shortly after ADOC had announced that the execution was postponed. Ivey’s Office stated that she expects that the execution would be restarted as soon as possible.

Alabama is committed law and order and the upholding of justice. Ivey stated that, despite the circumstances leading to the cancellation of the execution, it will not change the fact that a jury considered the evidence and reached a decision. It does not change that Miller did not deny his crimes. It does not change that the three families are still grieving. We all know that Terry Lee Jarvis, Christopher Scott Yancey and Michael Holdbrooks did not choose to be killed by bullets to their chests.

She added: “Tonight, my prayers are with the victims’ families and loved ones as they are forced to continue reliving the pain of their loss.”

After lower courts had previously opposed the execution, the Supreme Court approved execution by lethal injection in a 5-4 vote Thursday evening. Miller’s lawyers claimed that the state had lost paperwork to request an alternative execution method. This was the point of contention.

Alabama Attorney GeneralSteve Marshall argued that there is no evidence supporting this claim and requested an earlier federal appeals court to lift an injunction stopping execution.

Miller was sentenced after being convicted by the jury. on capital murder chargesFor the deaths of Lee Holdbrooks and Christopher Scott Yancy, Terry Jarvis, on Aug. 5, 1999, in Shelby County, a suburb near Birmingham.

Miller worked as a driver for a delivery truck at the time. Holdbrooks shot and killedYancy at Ferguson Enterprises, Pelham before driving a few kilometres to Post Airgas (a former employer) and killing Jarvis, according the Alabama News Network.

Miller was captured following a chase on the highway. Each man was shot multiple time.

The trial testimony showed that Miller killed the men after he believed that they were spreading rumors, including that Miller was gay. Miller was found guilty by a defense psychiatrist. Delusions caused by and severe mental illness, but said his condition wasn’t bad enough to use as a basis for an insanity defense under state law, according to court documents.

Miller was scheduled to be the third execution of the state for the year, after Matthew Reeves in Jan and Joe Nathan James Jr. late July.
