After being shot while trying to surrender, a suspect sues Minnesota police

A Minnesota sexual assault suspectThe victim, who was hiding in a dumpster naked when police shot him two years ago, has filed a lawsuit against Saint Paul Police Department for being shot while he was “unarmed” or “attempting to surrender.”

The suit was filed Monday by Joseph Washington. According to FOX 9, he claimed that he had followed officers’ orders and “naked and unarmed” and tried to surrender to police when a K-9 attacked him in November 2020.

The K-9 officer is being accused of using excessive force and unnecessary use of force.

The lawsuit claims that another officer shot Washington, in an instance of “unnecessary, excessive use of force”.

A suspect who was shot by police after hiding naked in a dumpster two years ago has filed a lawsuit against the Saint Paul Police Department for shooting him while he was "unarmed" and "attempting to surrender."

According to the lawsuit, Use of force by officersWashington suffered “physical pain and trauma; psychological trauma, anguish, and distress; permanent injuries; diminished quality of life; and medical costs.”

The suit names the City of St. Paul as well as officers Anthony Dean, Colleen Rooney as defendants. This lawsuit claims that their actions violate Washington’s Fourth Amendment rights. Further allegations include battery and negligence. 

Washington asks the court to grant him judgment on all claims against the defendants. Washington also seeks punitive and compensatory damages as well as reasonable attorneys fees.

Washington crashed his vehicle with his victim, and then he broke into a nearby residence. The homeowner called authorities and they arrived to find Washington naked in a dumpster.

One officer used an irritant to get Washington to leave the dumpster. Washington ran towards officers who used Tasers to stop him.

Officer Dean shot him at least once more. Washington was not shot by Officer Dean. Dean was later relieved from his duties.
