231 Nurses Are Denied Overtime Pay.

Two Pennsylvania nursing homes denied overtime pay to hundreds workers.

A judge Two companies were ordered256,684 to 231 nurses in back wages, and the same amount in liquidated damages equal to $513 3688, per The Department of Labor. Insider estimates that each nurse will be paid approximately $2,222. 

After an investigation by department’s Wage and Hour Division, the order revealed that Spring Creek operates. Spring Creek Rehab and Nursing Center, Harrisburg, and Franklin Center OPCO LLC (Operator of Laurel Lakes Rehab and Wellness Center, Chambersburg).Participated in pay practices which violated the Fair Labor Standards Act. 

The investigation discovered that nursing facilities paid nondiscretionary bonuses to nurses, but did not include incentives in the overtime pay rates.

Employers received bonuses for taking on extra work, working certain shifts, or providing additional support during the pandemic. It was also found that employers did not keep accurate records of hours worked.

Spring Creek Insider asked Franklin Center to comment, but it didn’t respond immediately.
